Sometimes it is necessary to protect the older person's assets so that they will not have to live in poverty without medical care in their last years. There are many programs available through the county, state and federal governments that are intended to provide services to the elderly; however, applying for these programs and meeting their eligibility requirements can be a daunting task for the elderly and their families.

For those elderly clients who did not have an estate plan in place, sometimes it is too late to give someone power of attorney over your financial and personal decisions. It is at that time that guardianship proceedings need to be instituted in Orphans' Court so that a close friend or family member or an independent agency can be appointed to make decisions for the incapacitated person - both personally and financially.
